By receiving services from Dere Information Technologies (LLC) (hereinafter referred to as "ServerAdresi"), you acknowledge and accept all the terms and conditions stated in this agreement. ServerAdresi, its content creators, employees, and any person or entity authorized by ServerAdresi shall bear no legal or criminal responsibility for any material or moral damages arising from your failure to read or comply with these terms. ServerAdresi reserves the right to update or modify this agreement unilaterally at any time without prior notice.
1. Responsibilities
1.1: ServerAdresi shall provide the service requested by the customer. Upon the acceptance of the order and confirmation of the payment, ServerAdresi commits to delivering the specified service.
1.2: The payment method and VAT differences will be included in the total amount displayed during the order. The total payable amount will be communicated to the customer by ServerAdresi based on their chosen payment method.
1.3: After the order is accepted and the transaction is confirmed, ServerAdresi will provide the customer with the necessary details related to the service. The protection of this information is the sole responsibility of the customer, and any damages or losses resulting from this shall be borne by the customer.
1.4: The customer agrees to comply with all declarations and warnings issued by ServerAdresi regarding the use of the service.
1.5: The customer undertakes not to attempt unauthorized access to files or programs and to bear all responsibility for any damages caused by such actions.
1.6: The customer is solely responsible for all files, documents, programs, websites, and activities hosted within the scope of the service and agrees to bear all legal and criminal liability for any illegal content. ServerAdresi is not liable for reviewing, verifying, or endorsing any content created by users. If these general guidelines are violated, or if ServerAdresi believes the service is harmful to its business or users, it may terminate the service without notice. Any illegal content may be removed without prior notification.
1.7: ServerAdresi shall not be held liable for any damages arising from the misuse or content of data, including emails, within the service. Data backup and retention are the customer's responsibility. ServerAdresi is not liable for interruptions, data loss, or any damages that may occur.
1.8: If the customer engages in defamation or excessive negative criticism of the company on the internet or elsewhere, their account and services may be terminated without liability on the part of ServerAdresi.
1.9: If the customer violates any term of this agreement or provides false information, ServerAdresi may access and examine the customer's server files.
1.10: ServerAdresi shall not be held liable for software-related issues not caused by them. All server services are provided unmanaged, and the customer is fully responsible.
1.11: The service will be delivered within 48 hours after payment. If the service is not delivered within this time, the customer may request a refund.
2. Pricing
2.1: The service fee is specified at the time of ordering. VAT will be calculated and collected separately if not included.
2.2: ServerAdresi reserves the right to change prices and rates without prior notice. The customer accepts such potential changes in advance.
2.3: If the price is quoted in foreign currency, the Central Bank's effective selling rate on the invoice date will be used to convert the amount into Turkish Lira.
2.4: In case of delayed payment, ServerAdresi reserves the right to issue an exchange rate difference invoice.
2.5: ServerAdresi reserves the right to activate or deactivate the service until payment is completed.
3. Suspension of Services
3.1: Services may be suspended or canceled in case of non-payment or breach of contract.
3.2: Hosting illegal content (bruteforce, spam, DDoS, hacking, warez, adult, copyrighted content, etc.) is strictly prohibited.
3.3: If illegal activities (e.g., spam, phishing, attacks) are detected on the server, ServerAdresi may immediately terminate the service without refund.
3.4: Software security on the server is the customer's responsibility. ServerAdresi is not liable for software vulnerabilities.
3.5: Services will be suspended if invoices are not paid on the due date, and ServerAdresi is not responsible for any consequences.
3.6: Outgoing attacks from servers are prohibited. Services involved in such activities will be terminated without notice.
3.7: Excessive internet usage that may affect other customers is prohibited. Customers will be warned, and persistent abuse will result in restrictions.
3.8: Long-term high read/write operations are not allowed on shared SSD virtual servers. Customers will be warned and restricted if abuse continues.
4. Communication
4.1: The postal addresses provided during the order process will be considered as legal residence for notifications.
4.2: ServerAdresi may send notifications via email, and such notifications will be deemed legally delivered within one day.
5. Refund Policy
5.1: Refunds are only available for web hosting services.
5.2: Customers must request a refund within 7 days of activation to be eligible.
5.3: Payments made for credit top-ups or service extensions are non-refundable.
5.4: If the customer cannot issue a refund invoice, ServerAdresi will deduct the VAT and transfer fees from the refund.
5.5: ServerAdresi reserves the right to process refund requests within 7 days.
6. Faults and Failures
6.1: Servers are electronic devices and may fail despite optimal conditions. Parts will be replaced as soon as possible.
6.2: ServerAdresi is not liable for delays caused by hardware replacement.
6.3: Backups are the customer's responsibility. ServerAdresi is not responsible for data loss due to disk failure.
6.4: ServerAdresi accepts no responsibility for data loss in managed service mistakes.
6.5: ServerAdresi is not liable for downtime during datacenter or IP changes. Reactivation may take up to 10 business days.
7. Termination
7.1: If the customer violates any terms or provides false information, ServerAdresi may terminate the contract unilaterally. No refund will be provided, and the customer agrees to pay 5 times the current contract fee as a penalty.
7.2: The customer may terminate the contract at the end of its term by providing written notice 10 days in advance. Early termination will require the customer to pay 50% of the remaining balance in full.
8. Contact and Notification Addresses
8.1 – 8.3: The addresses provided in the order form are considered official. All notifications will be sent there unless changed in writing. Email communications are deemed delivered within one day.
9. Payment Defaults
9.1: Failure to pay within 7 days after order results in default. ServerAdresi may charge a 25% monthly interest.
9.2: In legal proceedings, the customer agrees to pay a 25% interest, 50% penalty, 10% attorney fees, and all legal expenses.
9.3: For precautionary seizure or injunction requests, the customer agrees to cover any related bank fees.
9.4: Services may be suspended or deleted without notice if not paid within 7 days of the due date. No recovery or backup requests will be honored.
10. Hosting Usage Terms
10.1: On shared hosting servers, each customer may use a maximum of 25% CPU. Sites exceeding this may be suspended without notice, and ServerAdresi bears no liability for resulting damages.
Privacy Policy
Online Payments: All credit/debit card payments are secured with 256-bit SSL encryption. Virtual keyboard features help protect against keyloggers. Card information is not visible to ServerAdresi.
Collected Information: Depending on the service, the following may be collected: name, ID number, email, phone number, address, etc. These are only used for billing and legal purposes.
Data Use: ServerAdresi uses your data to provide services and updates. Data is not shared without consent unless legally required. You may request data deletion unless you have an active service.
Site Visits: Visitor information is tracked anonymously for statistical purposes only.
Security: The website is protected with firewall and antivirus measures. Transactions are encrypted via RapidSSL. PCI-DSS scans are regularly conducted. Users are responsible for securing their own systems.
Legal Disclosure: ServerAdresi may share user information with authorities without prior notice when legally required.
